Terms of Service

1. Acceptance of terms

By accessing or using MindOptimal at tomdyn.com (“the Service”) you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 13 years old (16 in the EEA) to use the Service. By using it you represent that you meet this requirement.

4. Account terms

• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must provide accurate information when registering and keep it up to date.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk to the Service or other users.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, abusive, harassing, defamatory, or fraudulent purpose.
• Attempt to bypass rate limits, scrape the Service at scale, or access it through automated means without our prior written permission.
• Reverse-engineer the Service or any underlying AI prompts, models, or infrastructure.
• Submit content that violates the intellectual-property or privacy rights of others.
• Use the Service to generate content that is sexually explicit involving minors, instructions for violence, or material prohibited by applicable law.

6. Intellectual property

The Service — including its design, code, prompts, illustrations, brand, and original written content — is owned by MindOptimal and protected by copyright and other intellectual-property laws. You may share AI-generated results for personal, non-commercial purposes (this is what the Share buttons are for). You may not resell, repackage, or scrape our generated content at scale.

You retain ownership of the inputs you submit (your quiz answers, free-text descriptions). By submitting them, you grant us a non-exclusive, worldwide, royalty-free license to process them for the purpose of providing the Service to you.

Third-party trademarks (e.g. Myers-Briggs Type Indicator®, MBTI®) referenced for educational context belong to their respective owners. MindOptimal is not affiliated with these organizations.

7. Payments and subscriptions

Paid reports and subscriptions are processed by Stripe, our payment processor. Prices are shown in USD unless noted otherwise and are subject to applicable taxes. Subscriptions renew automatically until cancelled. See our Refund Policy for refund terms.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated results will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, MindOptimal and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our aggregate liability for direct damages is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the operator's jurisdiction, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be announced on the homepage. Continued use of the Service after changes take effect constitutes acceptance.
